Content & Deliverables Consent
*Terms and Conditions
By applying to the PCHEEBUM Influencer, Athlete Ambassador & Affiliate Crew and ‘if approved’ you agree to a minimum requirement of '3' organic 'feed’ social media posts in addition to ‘3’ 'story sets' (3-5 continuous disappearing story style posts back-to-back) in reciprocation for consideration of free product.
At current the MSRP value for a PCHEEBUM+ is $4,999 (+ Tax and shipping). Our team will monitor and review then if we see it's a great fit you have the opportunity to be onboarded as part of the full-time PCHEEBUM Influencer, Athlete Ambassador & Affiliate Crew.
You also agree to give PCHEEBUM Inc, otherwise known as PCHEEBUM the global content rights to this content and agree to it being shared via our channels (any and all) and repurposed for digital ads as we see fit.
Content & Deliverables Consent Agreement
This PCHEEBUM Influencer, Athlete Ambassador & Affiliate Content & Deliverables Consent Contract (the "Contract") is entered into between [Influencer, Athlete Ambassador or Affiliate Name], hereinafter referred to as the "Influencer," and PCHEEBUM Inc, trading as PCHEEBUM, hereinafter referred to as the "Company."
Content Creation and Deliverables:
I agree to create a minimum of three (3) organic 'feed’ social media posts in addition to three (3) 'story sets' (3-5 continuous disappearing story style posts back-to-back) featuring PCHEEBUM products as part of the PCHEEBUM PCHEEBUM Influencer, Athlete Ambassador & Affiliate Crew program. Some great examples of this are typically, but not limited to, an unboxing style video, review post, meet PCHEEBUM, workout video, and more…
Disparaging Posts, Conduct, or Behavior
The Influencer, Athlete Ambassador or Affiliate acknowledges that maintaining a positive and respectful online presence is essential for the success of the collaboration and the reputation of PCHEEBUM. As such, any disparaging posts, conduct, or behavior by the Influencer that is deemed harmful, offensive, or detrimental to the brand, PCHEEBUM, or any associated parties will not be tolerated.
Recourse for Disparaging Posts, Conduct, or Behavior
In the event of disparaging posts, conduct, or behavior, PCHEEBUM reserves the right to take appropriate actions to address the issue, which may include, but is not limited to, the following:
Content Removal: PCHEEBUM may request the Influencer, Athlete Ambassador or Affiliate to promptly remove or edit any content that is in violation of the agreement.
Termination: PCHEEBUM reserves the right to terminate this agreement with immediate effect if the Influencer, Athlete Ambassador or Affiliate engages in disparaging posts, conduct, or behavior that significantly tarnishes the brand or its image.
Legal Action: In cases of severe harm or breaches that result in substantial damage to PCHEEBUM or its reputation, PCHEEBUM may pursue legal action to seek appropriate remedies and compensation.
Recall of Products: PCHEEBUM may request the return of any products provided to the Influencer, Athlete Ambassador or Affiliate as part of this agreement. All associated costs will be borne by the Influencer, Athlete Ambassador or Affiliate.
The Influencer, Athlete Ambassador or Affiliate acknowledges that these actions are at the sole discretion of PCHEEBUM and are in addition to any other remedies available under applicable laws. The Influencer further understands that PCHEEBUM’s decision to take any of these actions will be guided by the severity and impact of the disparaging posts, conduct, or behavior.
By agreeing to this contract, the Influencer, Athlete Ambassador or Affiliate affirms their commitment to maintaining a positive and respectful online presence and agrees to abide by PCHEEBUM's standards of conduct.
Grant of Rights:
I grant PCHEEBUM a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, publicly display, and perform the content I create for promotional and marketing purposes related to PCHEEBUM products. This may also be shared and reproduced worldwide by the various PCHEEBUM entities.
Compensation and Consideration:
I acknowledge that for what I am agreeing to in this agreement, compensation will be provided in the form of free PCHEEBUM products with a current MSRP of $4,999 (+ Tax and shipping).
I may be issued with a discount code to share via channels such as social media.
PCHEEBUM may in the future entertain re-engaging with me for further and future content, deliverables and work that may/or may not be compensated with product or cash. This will have a separate agreement attached and is not guaranteed, it's based on performance and the decision will be solely at the discretion of PCHEEBUM.
Confidentiality:
I understand and agree to treat confidential information obtained during this collaboration as strictly confidential.
Representations and Warranties:
I represent and warrant that I have the necessary rights and permissions to grant the rights outlined in this agreement.
Termination:
Either party may terminate this agreement for a material breach of its terms.
Governing Law:
This agreement shall be governed by the laws of Delaware, United States of America.
By selecting "I accept" in the application, I acknowledge that I have read and agree to the above terms and conditions.
